In a proceeding under section 330 of the Election Law, to annul the Board of Elections' determination sustaining the validity of the petition nominating Robert E. Barnes as the candidate of the Civic Action party for the public office of Borough President of the Borough of Queens, City of New York, the said candidate appeals from an order of the Supreme Court, Queens County, entered October 19, 1961 upon the decision of the court after a non-jury trial, which: (a) granted the petition, (b) annulled the board's determination, (c) invalidated said nominating petition, and (d) restrained the board from placing said candidate's name upon the ballot as said party's nominee for said office. Disposition Order affirmed, without costs.
